The EU Settlement Scheme Deadline is 30th June

Following the UK’s full departure from the EU on 1st January 2021, the EU Settlement Scheme is approaching its deadline. As an individual, the following information will help you to complete the application process to remain in the UK. As an employer, knowing the facts surrounding the scheme will allow your business to remain compliant and in control of its recruitment processes.

 

Why apply?

If you’re an EU, EEA or Swiss citizen, you and your family need to apply to the EU Settlement Scheme by Wednesday 30th June 2021 in order to continue living in the UK.

 

What happens then?

If your application is successful, you’ll receive either settled or pre-settled status:

  • Settled status is usually applied if you’ve continuously lived in the UK for at least five years. This means that you’ve been here for at least six months in any twelve-month period. The only exceptions are if you spent one period of up to twelve months away for an important reason (e.g. childbirth, studying, serious illness, vocational training or an overseas work posting), or because you were either doing compulsory military service for any period of time, or you were away as a Crown servant or the family member of one.
  • Pre-settled status applies if you’ve spent less than five years in a row in the UK. It’s crucial that you started living in the UK by 31st December 2020, unless you are applying as the existing close family member of an EU, EEA or Swiss citizen who had started living here by then.

 

What do I need to apply?

For the application to commence, you’ll need to provide the following:

  • Proof of identity
  • Proof of continuous residence

In addition, if you’re aged 18 or over and have any criminal convictions, the Home Office will check that you haven’t committed serious or repeated crimes. This is to ensure that your application for settlement doesn’t pose a threat to the UK’s security. However, you don’t need to declare any of the following if they apply:

  • Convictions that do not need to be disclosed (spent convictions)
  • Warnings or cautions
  • Alternatives to prosecution, such as speeding fines
